Slovak Residence Permit Validity Check

Are you a foreign national living in Slovakia with a temporary or permanent residence permit and unsure whether your residence status is still valid? The expiry date printed on your residence card does not always tell you how long you may legally stay.

Many foreigners assume that the date on the card automatically decides how long they can remain in Slovakia. In certain situations, the legal validity of your residence differs from the date on the physical document. At Miklosko.eu, we can verify your current residence status and clarify whether you are entitled to stay in the Slovak Republic.

Why the expiry date on your residence card is not always decisive

1. Limits linked to your passport or accommodation

A residence card may be issued for a shorter period than the law allows. Its validity can be limited, for example, by the validity of your passport or by the period for which you proved accommodation in Slovakia.

The expiry date of the physical card and the legal validity of your residence status are therefore not identical in every situation.

2. Automatic extension of residence by law

Slovak legislation contains specific cases in which certain types of residence are extended automatically. Special provisions were introduced in connection with the emergency situation declared because of the mass influx of foreigners after the armed conflict in Ukraine.

Under these provisions, certain temporary residence, permanent residence and tolerated residence permits that would otherwise expire during the emergency situation may remain valid until two months after the emergency situation is revoked, but no later than 15 July 2027 (Section 131k of Act No. 404/2011 Coll. on the Residence of Foreigners).

Whether this applies to you depends on your individual circumstances and on the statutory exceptions. For example, it does not apply in the same way to every foreign national whose application for renewal of temporary residence was rejected. It is therefore important to establish whether the extension applies in your case and whether the relevant legislation is still in force.

3. Revocation of your residence permit

The competent Slovak authorities can revoke your residence permit if a statutory ground for revocation arises. In some cases the Foreign Police start administrative proceedings or issue a decision on the termination or revocation of residence.

A common problem is official correspondence that is delivered to your registered address but never collected. You may then not know that proceedings were started or that a decision has already been issued.

Not collecting or not reading an official letter does not necessarily prevent its legal effects.

How we help you verify your residence status

If you are unsure whether your residence permit is valid, you need reliable information about your legal status first. We help you assess your situation and identify the right legal steps.

  1. Verification with the Foreign Police. We determine which Foreign Police department is responsible for your residence file and, within the applicable procedures and authorisations, help verify the relevant information in the official records.
  2. Assessment of your current legal status. We assess whether your residence is currently valid, whether proceedings on its revocation or termination have been started, and whether you can rely on a statutory extension of residence.
  3. Legal advice and next steps. If we find a problem, we advise you on the available options and help with the appropriate application, administrative proceedings or other steps needed to resolve it.

Why verifying your residence permit matters

Staying in Slovakia without a valid legal basis can have serious consequences. Depending on the circumstances, these include:

  • administrative expulsion from the Slovak Republic,
  • an entry ban affecting Slovakia and potentially the wider Schengen Area,
  • difficulties with employment or business activities,
  • complications when travelling internationally or crossing borders,
  • problems with future residence permit applications.

Do not rely only on the date printed on your residence card. Your actual legal status should be assessed under the applicable Slovak legislation and your individual circumstances.

Časté otázky

Otázky a odpovede

Is my stay legal if my residence card has expired?

Not necessarily either way. The legal validity of residence can differ from the date on the card, for example because of a statutory extension. It has to be assessed in your individual case.

What if I did not collect a letter from the Foreign Police?

Not collecting an official letter does not necessarily prevent its legal effects. Check your status as soon as possible, because deadlines for remedies may already be running.

What do I need to send you?

The name of the Foreign Police department that issued your card, the city of your registered residence and a short description of your situation.
